RIMOFTHEWORLD.net is seeking legal assistance regarding a matter of a potentially litigious user. Particularly, we are looking for any attorney who could assist with Internet, speech, and liability issues, and investigating possible vexatious litigation. Any assistance in this would be greatly appreciated. Please contact us with the form below or at our office at (909) 867-1901.
Thanks,
Scott Straley

Scott, that just sucks!!! I know we have at least a few lawyers on this site, I do hope one of them can provide you with the help you need.
One suggestion... if you don't get a response over here, post on all communities, where more people look. I wouldn't have seen this except I'm addicted to the Buzz!!!!!
Good luck!!!

Scott, I hope this isn't troubling you too much.
A lawyer I know is going to try to get you a good referral.

Gee, who could this be? Is it a currently banned "user"?
One with many names?.. Or a currently allowed user?

maybe you should require new users and current users to release Rim of the World.net against any lawsuits from any comments made on the site.

I see Torsten is at it again! That little town of AO has some big issues! Ban the whole town from site and save legal fees later

Its fun to watch though. Too bad they cant figure out the right people to sue and blame the site for eveything! I would think the artical 5 disclaimer would cover ROTW from all lawyer attacks and also the TOS was violated many times over there so again ROTW is not lieble.
Torsten, you're an idiot!

Vexatious litigation is legal action which is brought, regardless of its merits, solely to harass or subdue an adversary. It may take the form of a primary frivolous lawsuit or may be the repetitive, burdensome, and unwarranted filing of meritless motions in a matter which is otherwise a meritorious cause of action. Filing vexatious litigation is considered an abuse of the judicial process and may bring down sanctions on the offender.
A single action, even a frivolous one, is not enough to raise a litigant to the level of being declared vexatious.
Repeated and severe instances by a single lawyer or firm can result in eventual disbarment.
Some jurisdictions have a list of vexatious litigants: people who have repeatedly abused the legal system. Because lawyers could be disbarred for participating in the abuse, vexatious litigants are often unable to retain legal counsel, and therefore represent themselves in court. Those on the list are usually either forbidden from any further legal action or required to obtain prior permission from a senior judge before taking any legal action. The process by which a person is added to the list varies among jurisdictions.

good luck in finding an attorney in this area that actually cares about your issue and not the ca$h.

That must be why Torsten is encouging others to sue. Last time he pulled this ROTW.net wrote an artical about him, thought it was funny. The complaing user here is Torsten Kunert who with some investers bought most of the town of Angelus Oaks and have been trying to dump it as of late but cant. They have not made too many freinds in AO and the people that live there have not liked the changes T and the gang of eight have made. Here it is...
RIMOFTHEWORLD.net examined the posts by this other user and found them to be within the Terms of Service for the site. This, however, appeared to upset the complaining user who repeatedly called RIMOFTHEWORLD.net's Editor-In-Chief's home phone number to complain about the other user.
The complaining user, however apparently has a history of lodging complaints against websites. In 2000, he requested that the Matchmaker website was responsible for the activity of its users, when he wrote, " a group of 70 men, myself included, were slandered infront [sic] of thousands of Matchmaker.com members." He went on to write in his complaint that Lycos.com, the operator of Matchmaker.com "did not even have the decency to at least appologize [sic] to the concerned male members after they had spent months courting and paying for dinners, dates and services of decent lady members." There was no indication in the complaint as to what "services" these male users of the site were "paying for".
Although it appears that this individual operated an online rental service website in 2000 and an online classifieds site as of 2005, he does not appear to understand the liability of site operators regarding online user conduct and liability. There is sufficient legal precedence that immunizes site operators against users' conduct if the site does not actively edit the content of its users. However, this individual expects RIMOFTHEWORLD.net to actively police its content.
Additionally, this complaining user has difficulty complying with other aspects of civil law, having lost a small claims lawsuit. On February 16, 2007, a judgement against him for $2,448.18 was ordered. He is also a defendant and cross-complainant in an ongoing lawsuit.
Interesting talking to T on this site I found out he met his currant wife on matchmaker.com and has a couple of kids too. that site couldnt have been all that bad. Makes me wonder why people talk bad about him all the time, I think he is funny and would love to have a beer with him someday.

Great take corey...The user complaining about what is posted about them somewhere is like suing mc donalds when thier name is on grafiti in the bathroom...It isn't rotw's job to censor the forums...I would handle most of the complaints to rotw by ignoring them frankly. But some peeps be gettin all werked up in here...
Scott doesn't need legal representation a judge would toss a suit like that easy I think.
